Jason C. Tarasek

Jason C. Tarasek

Edina, Minnesota

Jason Tarasek is a construction attorney who resolves disputes through negotiation and, when necessary, litigation.

Battle Tested

Jason represents homeowners experiencing problems related to construction defects. In December 2013, Jason helped conduct a two-week construction-defect jury trial that resulted in a $2.1 million jury verdict for the client, a townhome association in Nisswa, Minnesota. Jason also obtained a favorable arbitration order for homeowners who fired their builder after the builder failed to demonstrate that it was capable of competently completing construction of the home.

Litigation Success

Jason often forecloses mechanic's liens on behalf of his contractor clients, who - when successful - may be entitled to recover their attorney's fees. Jason prevailed at trial for an engineering firm by obtaining a verdict that directed payment of more than $300,000.00 of overdue fees for professional services plus all of the attorney's fees that the firm incurred over the course of the litigation. He also successfully sued a state government agency to obtain overdue payments for an electrical contractor.

Adept in the Industry

Jason also assists contractors, engineers and architects in obtaining full payment for their work. He advises clients on the proper manner in which to preserve their payment rights and has litigated dozens of cases involving mechanic's liens and payment bond claims. Jason successfully represented a surety before the Minnesota Supreme Court in Safety Signs v. Niles-Wiese Construction, Inc., 840 N.W.2d 34 (Minn. 2013), a case involving an interpretation of Minnesota's payment bond statute.
